Terms and Conditions of Sale (CGV)

1. Purpose

These Terms and Conditions of Sale (CGV) govern the sale of services offered by the PixelRise platform, accessible online.

PixelRise provides a SaaS solution enabling:

• creation and management of websites
• management of bookings and contacts
• sale of products and services
• content automation
• management of digital projects
• registration and management of domain names
• performance analytics

Any subscription implies full acceptance of these CGV.

3. Nature of the service

PixelRise provides digital services accessible online by subscription. Services are provided "as is" and may evolve at any time to improve the platform.

4. Account creation

Access to services requires creating an account.

The client agrees to:

• provide accurate information
• keep credentials confidential
• assume all activities carried out via their account

PixelRise cannot be held liable for fraudulent access resulting from client negligence.

5. Subscriptions and pricing

Services are offered as monthly or yearly subscriptions.

Prices:

• are listed on the PixelRise website
• may be changed at any time
• apply to new subscription periods

Any started month is due.

6. Payment

Payment is made via the methods offered on the platform.

In case of payment failure:

• access to the service may be suspended
• some features may be limited
• data may be retained for a limited time

PixelRise reserves the right to terminate the account in case of prolonged non-payment.

7. Automatic renewal

Unless canceled by the client, subscriptions are automatically renewed at the end of the term. The client can cancel renewal from their user space.

8. Cancellation

The client may cancel their subscription at any time.

Cancellation:

• takes effect at the end of the current period
• does not result in any refund for the period already paid
• may lead to deletion of associated services

9. Refunds

Due to the digital nature of the service, no refunds are issued unless required by law or as an exceptional decision by PixelRise.

10. Domain names

PixelRise acts as a reseller of domain names via a third-party registrar.

The client acknowledges that:

• registration depends on registry and sponsoring registrar rules
• registration fees are non-refundable
• the client is responsible for domain renewal
• registration data must be accurate

ICANN policies apply to domain names.

11. Client responsibility

The client is solely responsible for:

• published content
• use of the service
• compliance with applicable laws
• commercial activities carried out via the platform

12. Service availability

PixelRise strives to ensure continuous availability of the service.

However, interruptions may occur for:

• maintenance
• updates
• technical incidents
• force majeure

No absolute availability guarantee is provided.

13. Limitation of liability

PixelRise cannot be held liable for:

• indirect or commercial losses
• data loss
• business interruption
• third-party actions
• damages related to service use

14. Changes to CGV

PixelRise may modify these CGV at any time. New versions apply upon publication.

15. Governing law

These CGV are governed by the laws applicable in Madagascar. In case of dispute, the parties agree to seek an amicable solution before any legal action.
